Terms of Service for Hippo Chatbot

Welcome to Hippo chatbot! These Terms of Service ("Terms") govern your access to and use of Hippo chatbot (the "Service"), which leverages advanced Large Language Models (LLMs) provided through a cloud-based AI service to provide AI-driven conversational assistance. By accessing or using the Service, you agree to comply with these Terms. If you do not agree, please discontinue use of the Service.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you are at least 18 years old (or meet the age of majority in your jurisdiction) and agree to abide by these Terms. If you are under 18, you must not use this Service.

2. Description and Use of the Service

Hippo is an AI-powered chatbot that provides responses based on user input. The chatbot uses OpenAI's LLMs as its underlying technology. While we strive to provide accurate and helpful information, the responses are generated by an AI system and may not always be correct or appropriate for every situation, or suitable for your specific needs.

2.1 Permitted Use

  • You are granted a non-exclusive, non-transferable right to use the Service for lawful purposes.
  • You may integrate the Service into your applications or workflows as outlined in these Terms.
  • Outputs generated by the Service are owned by you, subject to compliance with these Terms.

3. User Responsibilities

You agree to:

  • Use the Service only for lawful purposes and in compliance with all applicable Australian laws and regulations.
  • Avoid submitting harmful, illegal, or inappropriate content as input to the chatbot.
  • Refrain from using the Service to create or disseminate false, misleading, or harmful information.
  • Comply with Microsoft Azure’s Acceptable Use Policy and Code of Conduct.
  • Not attempt to reverse-engineer, extract, modify, or misuse the chatbot or its underlying technology and algorithms.

4. Data Usage and Privacy

  • Ownership: You retain ownership of the content you input into the chatbot ("User Input") and the output generated by the chatbot ("AI Output").

  • Processing: User Input and AI Output may be processed by third-party cloud platforms to provide responses. This processing occur mostly in Australia or other countries where Microsoft Azure operates with some certain exceptions due to service-specific requirements. We do not use this data to train AI or machine learning models unless explicitly permitted by you (opt-in).

    Alternative: User Input and AI Output are processed by Microsoft Azure cloud services to provide responses. Data processing is primarily conducted within Australia, leveraging Azure’s local data centres in Sydney and Melbourne. However, certain service-specific requirements may result in processing in other countries where Microsoft Azure operates, such as for globally distributed or non-regional services (e.g., preview features or specific AI deployments). We do not use your data to train AI or machine learning models unless you explicitly opt-in and provide consent.

  • Data Protection: We comply with applicable data protection laws, including Australian privacy laws such as the Privacy Act 1988 and Australian Privacy Principles (APPs). For more details on how we handle your personal information please review our Privacy Policy.

  • Security Measures: We implement security measures to protect your data; however, no system is completely secure. By using the Service, you acknowledge this risk.

  • Data Breach Notification: In compliance with Australian law, we will notify affected users and relevant authorities in the event of a data breach involving personal information.

5. Disclaimer of Accuracy

The AI Output provided by Hippo is generated by an artificial intelligence model and may contain inaccuracies or inappropriate content. The Service is not a substitute for professional advice (e.g., legal, medical, financial or other). You are solely responsible for how you use the information provided.

6. Prohibited Uses

You agree not to use the Service for:

  • Any unlawful activity or purpose.
  • Activities that violate intellectual property rights.
  • High-risk applications (e.g., medical diagnosis, financial decision-making) without proper safeguards.
  • Misrepresenting AI-generated content as human-generated.
  • Any activity that breaches Australian laws on defamation, hate speech, or misinformation.

7. Intellectual Property

All intellectual property rights in the chatbot’s design, branding, and underlying technology remain with Inject AI and third parties provisioning AI models. You may not copy, modify, distribute, or create derivative works based on the chatbot without prior written consent.

8. Limitation of Liability

To the fullest extent permitted by law:

  • Inject AI disclaims all liability for any damages arising from your use of the Service except where such liability cannot be excluded under Australian Consumer Law (ACL).
  • The Service is provided "as-is" without warranties of any kind except those required under ACL.

9. Termination

We reserve the right to suspend or terminate your access to the Service if you violate these Terms or if required by law or at our discretion.

10. Changes to Terms

We may update these Terms from time to time. Changes will be effective upon posting. Continued use of the Service after changes are posted constitutes acceptance of those changes.

11. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising out of or relating to these Terms shall first be resolved amicably through good faith negotiation between the Parties. If the dispute cannot be resolved within 30 days of written notice by one Party to the other, the dispute may then be submitted to the courts located in South Australia, Australia, or any other court within Australia with competent jurisdiction
